Consequences for the SellerThe consequences of selling a property with unconsented works can be very serious. If you sell your property and have carried out unconsented works, you would be in breach of that warranty (whether knowingly or unknowingly), and could be liable to pay the buyer compensation.
1. A building consent cannot be issued retrospectively for building work that has already been completed and a Code Compliance Certificate cannot be issued for any building works, which is subject to a CoA.
Document Purpose: The Certificate of Acceptance is a document that is issued by Contract Administrator (CA) to a Contractor after successfully completing the final acceptance criteria including all the contractual obligations and requirements.

The situation may arise where a building consent authority that is not a territorial or regional authority is unable or refuses to issue a code compliance certificate for which it granted a building consent. In such a situation, the owner may apply for a certificate of acceptance.

A building consent is a formal approval granted by your local council under the Building Act that allows a person to carry out building work. A council will issue a building consent only when it is satisfied the proposed building work will meet the requirements of the Building Code.
A resource consent is just what it says it is – approval for you to use a 'resource' such as land. You'll need one if you're planning to subdivide land or undertake any activity on a site that doesn't comply with the rules and standards of our District Plan.
Building consents are valid for 12 months from the date of issue. Building work must have commenced within the 12 months or the building consent will automatically lapse unless an extension of time to start work has been requested.
Notified applications for resource consents take around four to six months to process, depending on the complexity, significance and the level of contention involved.

You have 12 months from the day the consent is granted to begin work. You can apply for an extension of time for a maximum of 12 additional months. (In contrast you have about five years to use your Resource Consent).
A council will issue a building consent only when it is satisfied the proposed building work will meet the requirements of the Building Code. You cannot carry out any building work unless you have a building consent. There are a few minor exceptions to this set out in Schedule 1 of the Building Act.
A building consent is written approval from us to carry out specific building work on a specific site, which must comply with current regulations. It ensures that the proposed work is safe, durable and doesn't endanger the health and safety of anyone using the building.
A free standing closed in structure under 5m2 does not require a permit. Closing in an existing patio, veranda or similar structure under 5m2 does not require a permit. Any other conservatory or sunroom will require a permit.
This building consent is issued under section 51 of the Building Act 2004. This building consent also does not permit the construction, alteration, demolition, or removal of the building (or proposed building) if that construction, alteration, demolition, or removal would be in breach of any other Act.
All Building Consent and PIM applications must be accompanied by a recent copy of the Certificate of Title. This must be dated no older than 3 months.
